General Terms and Conditions Lindbergh Hotels
This document contains the General Terms and Conditions governing the booking of stays made remotely via a telematic network and therefore the contract that is concluded with the users of the various properties belonging to the hotel chain named Lindbergh Hotels.
In any event, the use of the online booking system contained in these sites implies acceptance and in all cases the application of these general conditions.
Lindbergh Hotels reserves the right to change the same Conditions without notice.
Acceptance of the General Conditions of Sale. With the use of the online booking service and the electronic transmission of the purchase order, the Customer unconditionally accepts and undertakes to observe these General Conditions, declaring to have read and accepted all the information contained therein pursuant to the aforementioned regulations and noting that Lindbergh Hotels will not be bound by different conditions unless previously agreed in writing. Any nullity or full or partial invalidity of one or more articles of these General Conditions in no way affects the validity of the other articles contained in the contract, which are to be considered valid and effective.

Customer commitments
a. The forwarding of the booking request implies the complete knowledge of these Conditions and their full acceptance.
b. The Customer undertakes and commits, once the online purchase procedure is completed, to print and keep the present Conditions already viewed and accepted during the booking process in order to fully satisfy the condition of the articles. 52 and 53 of Legislative Decree n. 206/2005.
c. To purchase the accommodation services offered by Lindbergh Hotels, you must be at least 18 years old or of legal age according to the laws of the country in which you reside. However, any bookings regularly completed, even if carried out by minors, forbidden or incapacitated, will still be fully valid and effective.
Purchasing method.
On the site of each individual property belonging to the Lindbergh Hotels chain, the different accommodations available with the related treatment, the related rates and the related special conditions (including that relating to the advances, payments, cancellation of the booking, etc.) are described. .). These rates are inclusive of VAT (except in cases of increase of the related rate, cases in which the Customer is required to pay the relative difference) but do not include any taxes due under local regulations, such as the Italian tourist tax which has to be paid directly at the hotel.
b. The Client will choose between the various available accommodations the one of his choice according to the relative tariff and the relative special conditions indicated at the time of booking, which are accepted at the time the purchase order is forwarded.
Before submitting this order and therefore before confirming the booking request, the customer will be shown the total cost of the services requested; the Customer is required to check this summary before proceeding with the payment (if foreseen by the chosen tariff) or to release the data of the credit card as a guarantee. Depending on the rate chosen by the Customer, in the execution of the purchase order the same Customer will be asked to choose the payment method (including Bank transfer, Credit card, etc.) or to insert the details of a credit card to guarantee the exact fulfillment of the obligations against him / her. After sending the said purchase order (or, according to the terms of the chosen tariff, after paying the amount indicated in the services summary or a deposit / down payment, or after have entered the details of the credit card as a guarantee) the Customer will receive an e-mail message to the address indicated therein containing a summary of his order, the booking number, the specifications of the service booked and the cancellation conditions of the same.

Contract Termination
The contract is concluded with the acceptance of the purchase / booking order by Lindbergh Hotels.
Depending on the different tariff chosen, only at the end of the payment foreseen or the credit card indicated as guarantee, the reservation will be definitively confirmed by Lindbergh Hotels.
In the absence of this good result, the Customer cannot make any claim.

Denial of the right of withdrawal
Article. 47 of Legislative Decree 6 September 2005 n. 206 of the code "Consumer Code" expressly excludes the applicability of the rules governing contracts concluded outside business premises, distance contracts and the relative right of withdrawal from contracts that fall within the scope of application of the regulations concerning travel, holidays and "All inclusive” circuits.

Penalty in case of cancellation or early departure
In the particular conditions relating to the type of accommodation / rate chosen - conditions available before purchase on the various websites of the Lindbergh Hotels chain - the possible penalties that will be applied in the event of cancellation / cancellation of the reservation by the Customer are also indicated.
In case of early departure Lindbergh Hotels is entitled to receive the payment for the entire booked period.

Refunds
Any refunds due to the Customer are made with the same payment method used by the Customer for the purchase of the service.


Beginning and end of stay. Package.
In all hotel facilities the rooms are available from 2 pm on the day of arrival and must be vacated by 10 am on the day of departure. The eventual early accommodation or release of the next room with respect to these times is subject to the payment of an extra fee on the spot.
The customer who has booked half-board accommodation is entitled to breakfast and dinner. For the full-board client the package usually begins with the dinner on the first day and ends with the lunch on the last day.
In no case it will be possible to obtain reductions for meals included and not consumed.

Reports at the time of booking
The special requests or preferences eventually indicated by the Customer in relation to the rooms (e.g.: neighboring rooms, rooms on the ground floor, rooms with double beds, etc.) are not binding for Lindbergh Hotels who will be free to accept them or not.

Customer Rights.
The Customer, whose booking has been regularly confirmed by Lindbergh Hotels and then paid according to the terms of the chosen rates, has the right to regularly use the services booked even if in compliance with the regulations of the accommodation facility.



Customer's obligations.
The Customer is obliged, at the latest at the time of departure, to pay all the fees due, including additional charges, related to extra services / benefits that the same Customer and / or the persons accompanying him / her have used, beyond the fee of stay if required; the credit card indicated as guarantee at the time of booking can be used by Lindbergh Hotels for the payment of all necessary fees, including additional charges.
The Customer is also responsible for any damage suffered by Lindbergh Hotels or by third parties, including other Customers, caused by him or caused by persons for whom he is responsible.

Hotel rights
If the Customer refuses to pay the fees due, even for additional services purchased on site, Lindbergh Hotels, in addition to being able to use the credit card indicated as a guarantee at the time of booking, based on the art. 2760 c.c. will also have the right of retention and lien on the client's belongings found in the hotel.

Hotel obligations
The hotel is obliged to provide the services and services booked and confirmed in accordance with its standard.
The hotel can make available to the customer an adequate substitute accommodation (of equal quality), by way of example and not exhaustive, in the case of an unusable room, in case of prolongation of the stay of the previous occupants of the room in question, in case of overbooking and in all the hypotheses in which the needs of the hotel impose a similar substitution.
Any additional costs related to the replacement accommodation are at the hotel's expense.

Liability for property damage
Lindbergh Hotels is liable for damages suffered by the Customer only if the damage occurred on the premises of the structure and the same or its employees are responsible for them.
If and inasmuch as it is unable to prove that the damage was not caused by the Lindbergh Hotels, its employees or by persons attending the facility, Lindbergh Hotels is liable for things brought into the premises by the Customer up to a maximum amount equivalent to one hundred times the daily price paid, even in the event of deterioration, destruction or theft of things, valuables, money and credit instruments
However, Lindbergh Hotels is not liable when the damage or theft occurred due to the customer, due to force majeure or the nature of the thing.
The custody of objects can be refused if they are dangerous (ie potentially capable of causing damage), too bulky or of excessive value.
Things are considered to have been introduced into the structure when they are taken over by a member of the staff of the receptive establishment or are taken to a place, within the receptive establishment, for the safekeeping of the same.
The Customer must report the fact without undue delay to the management of the structure in order not to lose the right to compensation (art. 1785 ter c.c.).

Maintenance
Lindbergh Hotels reserves the right to make changes and even carry out extraordinary maintenance to the structures, even during the period of opening to the public. Within the framework of the necessary maintenance activities, the Customer will consent, without being able to claim reimbursements and / or compensation, for work to be carried out in the rooms or in the other parts of the accommodation facility during his stay at the same.

Pets
Pets are not allowed inside the accommodation facilities.

Extension of the stay
The Client cannot claim the extension of the stay, which must always be requested in advance and then expressly accepted by Lindbergh Hotels.
If the customer cannot leave the hotel on the due date due to exceptional and extraordinary and unforeseeable circumstances (eg in the case of natural disasters, floods, strikes, etc.) and objectively precluded all the possibilities to travel, the stay will be automatically extended for the entire duration of the impediment, even in other accommodation indicated by Lindbergh Hotels.
The latter is authorized in such cases to request at least the price applied in low low season as payment.

Termination of contract law – Impossibility occurred for Lindbergh Hotels.
Lindbergh Hotels can terminate the contract with immediate effect if the Customer:
use the premises with serious prejudice to the property or make cohabitation with other guests intolerable by behaving arrogant, rude, disrespectful, scandalous or in any case reckless or guilty of actions or omissions towards staff Lindbergh Hotels, of other guests and / or persons in the hotel, punished by law as a crime in the event that they are suffering from a contagious disease or illness whose course exceeds the agreed period of stay or in the event that care is required details. If the enjoyment of the stay is not possible due to events of force majeure (eg natural disaster, strike, lockout, order of the Authorities, etc.), Lindbergh Hotels may terminate the contract at any time without notice and without the Customer being able to claim damages and / or compensation claims.

Complaints
If the Customer is not satisfied with the services provided, the relative complaint must necessarily be communicated without delay on the spot and directly to the Management of the structure.

Applicable law and competent court
These terms and conditions, as well as the relationships between the Customer and Lindbergh Hotels are in any case governed by the Italian law.
The Court of Pesaro will be exclusively competent for any dispute arising between the Customer and Lindbergh Hotels, with the exclusion of any other competent forum.


"Mandatory communication pursuant to Article 17 of Law no. 38/2006 - Italian law punishes with imprisonment crimes concerning prostitution and child pornography, even if committed abroad ".
